1. Introduction & Business Overview
This website and its associated services are operated by Beyond Limits Imports. By accessing our site, utilizing our vehicle sourcing services, or placing an order with us, you agree to be legally bound by these Terms of Service. Please read these terms carefully before engaging our services or committing to a purchase.
If you do not agree to all of the terms and conditions outlined here, you are not authorized to use our services or purchase vehicles through us.
2. Scope of Sourcing & Import Services
Beyond Limits Imports specializes in the sourcing, purchasing, and importation of Japanese Domestic Market (JDM) vehicles, automotive components, and branded merchandise.
Auction & Sourcing Data: Vehicle condition reports, translation of Japanese auction sheets, and grading assessments are provided in good faith based on data received from overseas partners and auction houses. They represent an honest evaluation but are subject to the inherent limitations of remote inspections.
Imperfections: Due to the age and nature of used JDM vehicles, photographs and written descriptions may not capture every minor cosmetic blemish, mechanical quirk, or wear-and-tear item.
Errors & Corrections: We reserve the right to correct any accidental listing errors, pricing mistakes, or structural misdescriptions. If an error affects an active order you have placed, we will notify you immediately to discuss adjustments before moving forward.
Inventory Availability: Availability of auction vehicles and ready-to-ship stock fluctuates constantly and is subject to change or prior sale without notice.
3. Eligibility, Ordering, & Deposits
By entering into an agreement or placing an order with Beyond Limits Imports, you confirm that:
You are at least 18 years of age and hold a valid driver’s license.
You possess the legal financial capacity to complete the vehicle acquisition.
All personal, registration, and billing information provided to us is accurate and complete.
Commitment Deposits
Sourcing vehicles from overseas requires a financial commitment. Any sourcing deposits, retainer fees, or initial vehicle payments are subject to the specific refundability terms outlined at the time of invoicing. We reserve the right to decline or cancel any order or sourcing request at our sole discretion, in which case any uncommitted funds will be promptly refunded.
4. International Transit, Customs, & Compliance
Because importing vehicles involves complex international logistics, maritime shipping, and federal border regulations, you acknowledge and agree to the following:
Government Tariffs & Port Fees: Unless explicitly wrapped into a "landed and cleared" flat-rate structure in your specific sales contract, all federal import duties, customs brokerage fees, port handling charges, and storage fees are the sole responsibility of the buyer.
Compliance & Legalization: Beyond Limits Imports assists in navigating regional import compliance laws (such as age restrictions and federal safety standards). However, the buyer is ultimately responsible for ensuring the vehicle complies with their specific state, provincial, or local registration and emissions laws.
Transit Timelines & Delays: Shipping estimates, ocean freight schedules, and customs clearance timelines are provided as educated projections. Beyond Limits Imports is not liable for delays resulting from shipping line disruptions, port congestion, customs inspections, weather events, or global logistics bottlenecks.
Risk of Loss: Risk of damage or loss during ocean transit is governed by the marine cargo insurance policy selected at the time of purchase. Beyond Limits Imports is not responsible for transit damage that falls outside the coverage limits of the third-party carrier or insurer.
5. Cancellations, Final Sales, & Refunds
The importation of custom-sourced vehicles involves immediate capital deployment for overseas purchase, inland transport, and ocean freight. Therefore:
Custom-Sourced Vehicles: Once a vehicle has been successfully won at auction or purchased from an overseas supplier on your behalf, the order cannot be canceled, and all associated payments are strictly non-refundable.
Finality of Sale: All vehicle sales are final. Because these are imported used vehicles, they are sold as-is, where-is with no implied mechanical warranties, unless a specific, written limited warranty is explicitly detailed in your bill of sale.
In-Transit Claims: If a vehicle arrives at its final delivery destination with severe, undocumented material discrepancies that diverge fundamentally from the auction sheet (excluding expected transit wear or minor cosmetic variances), you must notify us in writing within 7 days of taking delivery with comprehensive photographic evidence for evaluation.
6. Local Inspections & Registration Disclaimer
For vehicles purchased prior to clearing local safety inspections:
Beyond Limits Imports does not guarantee that a raw, un-inspected import will automatically pass local provincial or state safety inspections without requiring maintenance (such as new tires, brakes, lighting compliance modifications, or minor mechanical servicing).
Any post-import compliance modifications, out-of-province/state inspection fees, and registration costs are the responsibility of the buyer unless explicitly agreed otherwise in writing.
7. Intellectual Property
All media, logos, text, website layouts, photography, and digital content associated with Beyond Limits Imports are the exclusive property of our business or our content suppliers. You may not copy, distribute, modify, or use any of our brand assets for commercial purposes without our express written consent.
8. Limitation of Liability
To the maximum extent permitted by applicable law, Beyond Limits Imports, its owners, and its operators shall not be held liable for any indirect, incidental, special, consequential, or punitive damages arising out of the use of our sourcing services or the operation of imported vehicles. This includes, without limitation, claims for mechanical failure, loss of profits, downtime, or personal injury.
Our total financial liability for any claim connected to an import order or vehicle purchase shall never exceed the actual net amount paid to Beyond Limits Imports for our specific sourcing and importing services for that transaction.
9. Governing Law
These Terms of Service, along with any separate sales agreements or sourcing contracts, shall be governed by, interpreted, and enforced in accordance with the laws of British Columbia, Canada, without regard to conflict of law principles. Any legal actions or disputes must be filed and handled within the courts of British Columbia.
10. Modifications to Terms
We reserve the right to update, alter, or replace any part of these Terms of Service at our discretion. Any revisions become active immediately upon being posted to our platform. It is your responsibility to check this page periodically for changes. Your continued use of our services or placement of sourcing orders following any updates constitutes acceptance of those changes.
